Welcome to LiventNick, a personal portfolio and blog website. These Terms of Service ("Terms") govern your use of the contact form on this website. Please read them before submitting a message.
1. Acceptance of Terms
By submitting the contact form on this website — whether for a collaboration inquiry, a general message, or any other purpose — you acknowledge that you have read, understood, and agree to be bound by these Terms. This agreement is formed electronically and is valid and enforceable under the Electronic Commerce Act, 2000, S.O. 2000, c. 17 (Ontario) and applicable Canadian federal law.
If you do not agree to these Terms, please do not submit the contact form.

4. Prohibition on Hostile, Threatening, or Harassing Messages
LiventNick has a strict zero-tolerance policy toward hostile, threatening, or harassing communications.
Specifically, messages that constitute harassment may expose you to civil liability under Ontario’s tort law, including the tort of harassment as recognized in Ontario courts. Messages containing threats — including threats of harm, property damage, or reputational damage — may constitute a criminal offence under sections 264 (criminal harassment) and 264.1 (uttering threats) of the Criminal Code of Canada, R.S.C. 1985, c. C-46.
If you send a hostile, threatening, or harassing message through this contact form, the operator reserves the right to:
- Retain a record of your message and associated technical data (including IP address);
- Report the communication to appropriate law enforcement authorities;
- Pursue civil legal action in the courts of Ontario for any damages caused;
- Seek injunctive or other equitable relief as appropriate.
5. Collaboration & Project Inquiries
Submitting a collaboration or project inquiry through the contact form does not create a binding contract or guarantee acceptance of your request. The following applies:
- No obligation to accept: The operator reserves the absolute right to decline any inquiry at their sole discretion, for any reason or no reason, without obligation to provide an explanation.
- Creative and technical rights: Unless otherwise agreed upon in a separate, written agreement, the operator retains all creative rights, intellectual property rights, and technical ownership in any work produced.
- Terms and payment: Specific payment terms, timelines, deliverables, and scope will be defined in any separate written agreement prior to commencement of work.
6. Intellectual Property
All code, designs, blog content, and visual content displayed on this website are the intellectual property of the operator and are protected under the Copyright Act, R.S.C. 1985, c. C-42 (Canada). Nothing on this website grants you any licence or right to use, reproduce, distribute, or modify any content without express written permission.
The name “LiventNick” and any associated branding are the operator’s intellectual property. Unauthorized use is prohibited.
7. No Spam or Unsolicited Commercial Messages
In accordance with CASL, you agree not to use the contact form to send commercial electronic messages without express or implied consent of the recipient.
8. Limitation of Liability
This website and its contact form are provided on an “as is” basis. The operator makes no warranties, express or implied, regarding the availability, accuracy, or fitness of this website for any particular purpose.
To the fullest extent permitted by Ontario law, the operator shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the contact form. The operator’s total liability for any claim arising under these Terms shall not exceed CAD $0, as the contact form is provided as a free communication service.
Nothing in this clause limits liability for fraud, intentional misconduct, or any liability that cannot be excluded by law in Ontario.

10. Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the contact form shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
11. Dispute Resolution
The operator prefers to resolve disputes informally whenever possible. If you have a concern, you are encouraged to contact the operator directly in good faith before initiating formal proceedings.
If an informal resolution cannot be reached within 30 days of written notice of a dispute, either party may pursue their rights and remedies through the courts of Ontario.

This Privacy Policy explains how LiventNick, a personal portfolio and blog website, collects, uses, and protects personal information submitted through the website’s contact form.
This policy is written to comply with Canada’s federal Personal Information Protection and Electronic Documents Act (PIPEDA), S.C. 2000, c. 5, and applicable Ontario privacy considerations.

3. Cloudflare Turnstile (CAPTCHA)
This website uses Cloudflare Turnstile, a privacy-preserving CAPTCHA service provided by Cloudflare, Inc., to protect the contact form from automated spam and abuse.
When you interact with the contact form, Cloudflare may process certain technical information as part of the CAPTCHA verification process. Cloudflare’s data handling is governed by their own Privacy Policy.
Aside from Cloudflare Turnstile, no personal information you submit through the contact form is shared with any third party — no analytics platforms, no advertising networks, no data brokers.
4. How Your Information Is Stored
Contact form submissions are received and stored securely by the website operator. Server audit logs are retained for 90 days in accordance with the website’s server configuration, after which they are automatically deleted.
Message content, name, and email address may be retained in the operator’s email inbox or communication records for as long as reasonably necessary to manage your inquiry.
5. Retention Policy
- Server audit logs (IP address, user agent, submission timestamps): Retained for 90 days, then automatically deleted.
- Contact form submissions (name, email, message content): Retained only as long as necessary to respond to your inquiry.
- Collaboration correspondence: If a collaboration or project proceeds, related communications may be retained for the duration of the project and a reasonable period afterward for record-keeping purposes.
6. Your Rights Under PIPEDA
Under PIPEDA, you have the following rights regarding your personal information held by LiventNick:
- Right of access: You may request a copy of any personal information held about you. Requests will be responded to within 30 days as required by PIPEDA.
- Right of correction: If you believe any personal information held is inaccurate or incomplete, you may request that it be corrected.
- Right of deletion: You may request that your personal information be deleted, subject to any legal obligations to retain it.
- Right to withdraw consent: Where processing is based on consent, you may withdraw that consent at any time.
7. No Sale of Personal Information
Personal information collected through this website is never sold, rented, or traded to any third party. Full stop.
8. Cross-Border Data Considerations
Cloudflare, as a U.S.-based company, may process CAPTCHA-related technical data on servers located outside of Canada. By using the contact form, you acknowledge that this limited technical data may be transferred to and processed in jurisdictions outside Canada, subject to Cloudflare’s privacy commitments and applicable law.
All personal information you deliberately submit (name, email, message) remains under the control of the operator and subject to Ontario jurisdiction.
9. Cookies and Tracking
This website does not use tracking cookies, analytics cookies, or advertising cookies. Cloudflare Turnstile may use strictly necessary technical mechanisms to perform CAPTCHA verification; these are not used for cross-site tracking or profiling.
10. Changes to This Policy
This Privacy Policy may be updated from time to time. The effective date at the top of this document will be updated accordingly. Continued use of the contact form after any changes constitutes acceptance of the revised policy.
